By using the LocomoTravel website and services (the “Service”), including creating an account, booking tours, hotels, flights, or submitting content, you (“User”) agree to be bound by these Terms of Service. If you do not agree, do not use the Service. You affirm that you are of legal age to contract or have parental consent. LocomoTravel may revise these Terms at any time; continued use after changes implies acceptance.
LocomoTravel is a travel agency and travel blog offering bookings for tours, activities, accommodations, flights and related services. All bookings and travel services are provided through third-party suppliers (such as hotels, airlines, tour operators). LocomoTravel acts as an intermediary and does not own or control those services. You acknowledge that travel plans are subject to availability and the terms of the supplier. We make no guarantees about the quality, safety, or performance of any travel service and disclaim liability for actions or omissions of third parties. For example, one platform’s terms state that it “disclaims any responsibility and liability for the work performed or the tour services” by third-party operators. You agree to comply with all applicable travel regulations and supplier conditions.
Booking: When you confirm a booking, you authorize LocomoTravel to facilitate payment to third-party travel providers. You agree to provide accurate payment information.
Payment: Payments may be processed by third-party payment processors. All prices and payments are handled by suppliers; LocomoTravel is not responsible for payment disputes or failures by third parties.
Cancellation/Changes: Each booking is subject to the supplier’s cancellation policy (the “Itinerary Cancellation Policy”). If you cancel, refunds (if any) will be issued per that policy. Travel suppliers (hotels, tour operators, etc.) may change or cancel services at their discretion; when this happens, they may offer comparable alternatives. We accept no liability for any loss of enjoyment, delays, or changes imposed by suppliers. For example, one tour platform’s terms allow operators to “substitute alternative arrangements of comparable monetary value” and explicitly state “no liability for loss of enjoyment” from such changes. If LocomoTravel cancels due to your breach of these Terms, no refund is owed.
To use certain features (such as booking or commenting), you may create an account with LocomoTravel. You agree to provide truthful information (first name, last name, email, phone, address, etc.) and keep it updated. You are responsible for maintaining the confidentiality of your account credentials. You may delete or deactivate your account at any time. Upon termination or deletion of your account, LocomoTravel reserves the right to remove all your data and user-generated content, and such data cannot be recovered. You must notify us immediately of any unauthorized account use.
LocomoTravel may allow users to post content (comments, reviews, photos, blog posts, etc.). You are solely responsible for your submissions. By submitting content, you represent that you own the rights to it and that it does not infringe any third party’s rights or violate any laws. For instance, user content must not include copyrighted material without permission, or be defamatory, obscene, or illegal. LocomoTravel does not guarantee the accuracy or appropriateness of user submissions, and we may remove content at our discretion.
You grant LocomoTravel a worldwide, non-exclusive, royalty-free license to use, reproduce, and display your content for any purpose related to the Service. Many platforms similarly state that users retain ownership but grant the site broad rights: for example, one policy notes users automatically “grant the platform a license to use their content as they see fit” once uploaded. We may use your content in promotions or on our site. You also waive any moral rights to your submissions so we may modify or publish them without further permission.
You agree not to use the Service for any unlawful purpose or any purpose prohibited by these Terms. You will not spam, harass, defame, or post prohibited content. Violating these rules may result in account suspension or termination. LocomoTravel reserves the right to refuse service, terminate accounts, or remove content that violates our standards or applicable law.
LocomoTravel pages may include links or references to third-party websites, services, or advertisements (including affiliate links to hotels, flights, tours, or products). We do not control these third-party sites. As stated in similar travel terms, our inclusion of links is “solely as a convenience”; we do not endorse them or their contents. If you access any third-party link, you do so at your own risk and must comply with that site’s policies.
We may participate in affiliate programs. This means when you click an affiliate link or make a booking through certain links, LocomoTravel may earn a commission. You will not pay more by using these links. Such affiliate relationships and commissions will be disclosed in accordance with applicable law (for example, FTC guidelines require a clear, conspicuous affiliate disclosure). Affiliate disclosures will be provided where required.
No Warranty: THE SERVICE IS PROVIDED “AS IS” WITHOUT ANY WARRANTY OF ANY KIND, whether express or implied. We do not guarantee the Service will meet your needs or be uninterrupted, secure, or error-free. As noted in other travel terms, no implied warranty of merchantability or fitness is made
Limitation of Liability: To the fullest extent permitted by law, LocomoTravel and its partners will not be liable for any indirect, incidental, consequential, or punitive damages arising out of your use of the Service. In plain terms, even if we have been advised of possible damages, we are not responsible for losses related to booking errors, cancellations, injuries, data loss, or any other issues. For example, one travel provider’s terms explicitly exclude all liability for direct or indirect damages connected to site use. Our total liability, if any, will be limited to the amount you paid us for the specific service giving rise to the claim, or a nominal fee (e.g. $100), whichever is greater.
You agree to indemnify and hold LocomoTravel, its affiliates, and employees harmless from any claims or damages (including legal fees) arising out of your breach of these Terms or your negligent or wrongful use of the Service.
These Terms are governed by the laws of the jurisdiction where LocomoTravel is headquartered. Any disputes will be subject to the exclusive jurisdiction of the courts in that location (unless otherwise required by law). International users agree to comply with all local regulations when accessing the Service.
LocomoTravel may change these Terms at any time by posting updates on this page. We will note the “Last Updated” date. Your continued use of the Service after changes constitutes acceptance of the new Terms.
